Shubhi Rathore | Prabhat Bandhulya

An accused in a murder case, charged under Section 302 and 34 of the Indian Penal Code, 1860, applied to the Court to appear in the entrance exam of NLU, Delhi (AILET 2022). Shashank Jadon, the accused, had made a similar request in the year 2020 for taking this particular exam.

The Delhi High Court held that the accused is allowed to take the exam as his earlier request

made in 2020 was also allowed by the Court. Moreover, the Court observed that the right to get education is a Fundamental Right which cannot be curbed and in the interest of justice the

permission was granted. The Court made the following directions to the Supdt. Jail, make

necessary arrangements that the accused reaches the exam centre at an appropriate time and take him back properly. Furthermore, the Supdt. Is supposed to allow the accused to carry the necessary documents required for taking the exam. The Supdt. Was also directed to file a compliance report on June 28.
